Terms of Service

1. Acceptance of Terms
By accessing or using the QueueFree platform, website, or any associated services (collectively, the "Service"), operated by QueueFree (founded by Ashiq Rahman and Nifail S, hereinafter "QueueFree", "we", "us", or "our"), you ("Hospital", "Clinic", "Institution", or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and pilot-programme participants of the QueueFree platform.
2. Description of Service
QueueFree is a real-time digital queue and patient-flow management platform designed for Outpatient Departments (OPDs) in hospitals and clinics. The Service enables:
- Digital token issuance and queue management for OPD patients.
- Real-time queue status broadcasting to patients via SMS / WhatsApp.
- A command dashboard for hospital staff, doctors, and administrators.
- Aggregated, anonymised analytics on wait times and department throughput.
QueueFree is an operational infrastructure tool. We do not access, process, or store Electronic Medical Records (EMR) or clinical histories.
3. Eligibility & Authorised Use
The Service is intended for use by registered hospitals, clinics, and authorised healthcare institutions. By using the Service, you represent and warrant that:
- You are a legally registered healthcare institution or an authorised representative thereof.
- You have obtained all necessary consents from patients whose contact details are entered into the platform for the purpose of queue notifications.
- You will use the Service solely for lawful queue management and patient-flow purposes.
- You will not reverse-engineer, resell, or sublicense the Service without prior written consent from QueueFree.
4. Data Handling & DPDP Act Compliance
QueueFree is committed to compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) of India and applicable data protection regulations.
- Data Fiduciary / Data Processor: In the context of patient phone numbers entered by hospital staff, the Hospital acts as the Data Fiduciary and QueueFree acts as the Data Processor. The Hospital is responsible for obtaining valid patient consent before submitting personal data to the platform.
- Purpose Limitation: Personal data (e.g., phone numbers) is processed solely to deliver queue-position notifications and is not used for marketing, profiling, or any purpose beyond the agreed service.
- Data Minimisation: We collect only the minimum data required — typically a token number, an optional phone number, and department routing information.
- Retention: Temporary queue data is purged routinely per the hospital's data retention policy. We do not build consumer profiles from patient data.
- Security: All data is encrypted in transit (TLS 1.2/1.3) and at rest (AES-256). See our Security & Trust page for details.

5. Pilot Programme Terms
During the current pilot phase, QueueFree may provide the Service free of charge or at a subsidised rate to selected partner institutions. Pilot participants agree to:
- Provide reasonable feedback on platform performance and usability.
- Allow QueueFree to reference the institution as a pilot partner (subject to a separate NDA or reference agreement if required).
- Transition to a commercial agreement upon the conclusion of the pilot period, or cease use of the Service.
QueueFree reserves the right to modify or discontinue the pilot at any time with reasonable notice.
6. Intellectual Property
All content, software, designs, trademarks, and technology comprising the QueueFree Service are the exclusive property of QueueFree and its founders. Nothing in these Terms grants you any right or licence to use our intellectual property other than to access and use the Service as expressly permitted herein.
7. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. QueueFree makes no warranties — express, implied, or statutory — regarding the Service, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
QueueFree is a queue management tool and is not a medical device. It does not provide clinical advice, diagnosis, or treatment recommendations.
8. Limitation of Liability
To the maximum extent permitted by applicable law, QueueFree and its founders, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount paid by you (if any) for the Service in the three months preceding the claim.
9. Modifications to Terms
We reserve the right to update these Terms at any time. We will notify active partner institutions of material changes via email or a notice within the platform. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
